Terms of Service

The term Virtual Office Website ("VOW") refers to a Participant's (REALTOR®'s) Internet website, or a feature of a Participant's Internet website, through which the Participant provides real estate brokerage services to Registrants (clients and prospects) with whom the Participant has first established a relationship, where the Registrant has the opportunity to search for MLS® data, subject to the Participant's oversight, supervision, and accountability.

By agreeing to these VOW Terms of Use you:

• Acknowledge and understand that these Terms of Use do not create an agency relationship, do not impose a financial obligation on you as Registrant, and do not create any representation agreement between you (the "Registrant") and the Participant.
• Understand that all data obtained from the VOW is intended only for your personal, non-commercial use.
• Confirm that you have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the VOW.
• Agree not to copy, redistribute, or retransmit any of the data or information provided.
• Acknowledge the Board/Association's ownership of, and the validity of the copyright in, the MLS® database.
• Agree that all information you provide may be provided to the relevant Board/Association and may be used to administer and operate the VOW and to investigate any breach of security of the data or any violation of MLS® rules.
• Acknowledge that a "mouse click" is sufficient acknowledgement and agreement to these VOW Terms of Use.
• Must provide a valid e‑mail address. You may be permitted to access the VOW only after the Participant has verified that the e‑mail address provided is valid and your agreement to the VOW Terms of Use is confirmed.

Record Keeping

Understand that the Participant must at all times maintain a record of the name, telephone number, and e‑mail address supplied by you as Registrant, and the username and current password of each Registrant. Such records must be kept for not less than 180 days after the expiration of the validity of the Registrant's password. If the Board/Association has reason to believe that a Participant's VOW has caused or permitted a breach in the security of the data or a violation of MLS® rules related to use by one or more Registrants, the Participant shall, upon request, provide to the Board/Association a copy of the record of the name, e‑mail address, telephone number, username, current password, and audit trail, if required, of any Registrant identified by the Board/Association as suspected of involvement in the violation.

Information Accuracy

Understand that information on this site is deemed to be valid but is not guaranteed. It is your responsibility as Registrant to confirm all information on your own. The Broker may not have reviewed or approved listing enhancements. All information provided by the listing agent/broker is deemed reliable but is not guaranteed and should be independently verified.

Understand that any agreement entered into at any time between the Participant and Registrant that imposes a financial obligation on the Registrant or creates agency representation of the Registrant by the Participant must be established separately from these VOW Terms of Use, must be prominently labelled, and may not be accepted solely by mouse click.

By using this website or the services offered by this website, you acknowledge that:

• You may enter into a lawful broker–consumer relationship with eXp Realty (the "Brokerage"), the real estate brokerage with which hômm's licensed real estate professionals are registered, where applicable and in accordance with real estate legislation; and
• You may enter into separate relationships with hômm, a real estate company that operates this website and provides marketing, information, and services related to buying and selling real estate.

This website and its services are intended for use by non‑commercial buyers and sellers of real estate. You must have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through this website. Any commercial use of this website and/or its services is strictly prohibited unless otherwise authorized in writing by hômm and, where applicable, the Brokerage (eXp Realty).

You use this website and the services offered by this website at your own risk. The content on this website and the services offered by this website are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by law, hômm, eXp Realty, and their respective directors, officers, employees, and agents shall not be liable for any damages of any kind arising from or in connection with the use of this website or the services offered by this website, including, without limitation, direct, indirect, incidental, consequential, special, exemplary, or punitive damages.

This website, including its content and design, may not be reproduced or distributed in any form without prior written permission. All content on this website is owned by hômm (excluding MLS® data, third‑party content, and content where ownership is otherwise noted), and all rights are reserved.

You may not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any Listing Information to another individual or entity. The prohibited uses expressly include "scraping" (including "screen scraping" and "database scraping"), "data mining," or any other activity intended to collect, store, re‑organize, summarize, or manipulate any Listing Information or any related data.

You may not copy, redistribute, retransmit, or otherwise use any of the data or Listing Information provided, except in connection with your own consideration of the purchase or sale of an individual property.

You acknowledge RAE's ownership of, and the validity of RAE's proprietary rights and copyright in, the MLS® database, RAE's MLS® System, Listing Information, and any related information.

RAE and other Members of RAE, or their duly authorized representatives, may access this website for the purposes of verifying compliance with MLS® Rules and Policies (including the VOW Rules) and monitoring the display of Members' Listings by the VOW.

You agree to abide by all applicable local, provincial, state, national, and international laws and regulations pertaining to accessing and using the Service. You also acknowledge and agree that your use of the Internet to access the Service is solely at your own risk.

You are responsible for:

• Maintaining the confidentiality of any login credentials associated with your use of the Service;
• Ensuring that all information you provide is accurate, current, and complete; and
• Immediately notifying us of any unauthorized use of your account or any other breach of security that you become aware of.

By creating an account for the purposes of using the Service (an "Account"), submitting a contact form, or otherwise providing your contact information, you agree that the Company and/or the Brokerage may send you newsletters, marketing or promotional materials, and other information, including by e‑mail, SMS/text messaging, automated voicemail drops, and push notifications, all in accordance with applicable law.

You may opt out of receiving some or all of these communications at any time:

• You may opt out of receiving e‑mail communications by clicking on the "unsubscribe" link provided in any e‑mail sent by the Company and following the instructions provided.
• You may opt out of receiving SMS/text messages by replying "STOP" to any text sent by the Company.
• You may opt out of receiving phone calls by communicating that preference during the call or by contacting us using the details provided in our Privacy Policy or on the Site.

The Company will make commercially reasonable efforts to comply with any communications from you requesting an opt‑out of communications, subject to legal and regulatory obligations (for example, where certain communications are required for transactional or compliance purposes).

To purchase any product or service made available through the Service (a "Purchase"), you may be required to supply certain information relevant to your Purchase, including, but not limited to, your credit card number, card expiration date, billing address, and shipping information or preferences.

You represent and warrant that:

• You have the legal right to use any credit card(s) or other payment method(s) used in connection with any Purchase; and
• The information you supply to the Company related to a Purchase is true, correct, and complete.

The Service may employ third‑party services to facilitate payment and completion of Purchases. By submitting your information to the Service, you grant the Company the right to provide that information to its third‑party service providers, subject to our Privacy Policy.

The Company reserves the right to refuse or cancel any order or Purchase at any time for reasons including, but not limited to:

• Suspicion of fraudulent, unauthorized, or illegal activity;
• Availability issues;
• Errors in the description or listed price of a product or service; or
• Other errors or related reasons.

The Company is constantly updating product and service offerings on the Service. Occasionally, there may be delays between an update of information on the Service and a corresponding update to the Company's advertising or other materials. There is also potential for the information on the Service to contain errors, inaccuracies, or omissions, or to be incomplete or outdated.

The Company does not warrant the accuracy, completeness, or reliability of any information found on or through the Service. The Company reserves the right to update information, correct errors, inaccuracies, or omissions, and change or update information at any time without prior notice.

The Service may allow you to post, link to, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

Specifically, you must not:

• Post statements or other materials that are in any way libellous or defamatory; harass, abuse, threaten, or intimidate others; or otherwise infringe on the rights of others.
• Post or upload personal information, pictures, videos, or any other media belonging to another person without their express permission, or anything else that violates the privacy or publicity rights of another person or entity.
• Post anything that interferes with or disrupts the operation of the Service, including, but not limited to, posting files that contain malware, viruses, corrupted files, or any other type of file or data that may damage the functionality of another's computer or the Service.
• Repeatedly post the same message or similar messages within an unreasonable timeframe.
• Delete or revise any material from the Service posted by another user or by the Company without the express written permission of the Company.
• Post statements or materials that constitute spam or unauthorized advertising or promotional materials, including, but not limited to, links to commercial products or services.
• Post material that infringes, or may infringe, on any copyright, patent, trademark, trade secret, or other intellectual or proprietary rights of any party that you are not authorized to make available.

The Company reserves the right, but has no obligation, to monitor, edit, or remove Content that it determines in its sole discretion violates these Terms or is otherwise objectionable.

We may update or modify these Terms from time to time. When we do so, we will update the "Last Updated" date at the bottom of these Terms. We may also provide additional notice, such as by posting a notice on the Site.

Your continued use of the Service after any such changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
